Justice M.B. Idris of the Federal High Court sitting in Ikoyi, Lagos, today rejected an application filed by a former First Lady, Patience Jonathan, seeking a declaration that she owns the sum of $9.8m domiciled in Skye Bank.

The former First Lady, through her lawyer, I.A. Adedipe, SAN, had filed an application by way of amended originating summons dated December 15, 2016, seeking a declaration that she is the owner of the money and that she is entitled to access the funds without hindrance.


Adedipe had also sought an order of the court discharging the freezing of the account.

However, the prosecution had filed a counter affidavit, challenging the competency of the amended originating summons of the applicant. At today's sitting, prosecution counsel, Idris Abdullahi Mohammed, urged the court to reject the application filed by the defence counsel.

"My Lord, the facts in this case are in dispute; and it is a known fact that whenever a fact is in dispute, the appropriate way of commencing this suit is by way of writ of summons, which the applicant has refused to comply with."

In his ruling, Justice Idris upheld the submission of the prosecution counsel that the suit ought not to have commenced by the way of originating summons, which the claimant had done. Consequently, the judge ordered parties to file their applications by way of writ of summons before the court.

The money is part of the sum of $15.5m the Economic and Financial Crimes Commission, EFCC, had stumbled on in four bank accounts domiciled in Skye Bank Plc, while investigating a former Special Adviser to former President Goodluck Jonathan on Domestic Affairs, Waripamowei Dudafa. The names of the three companies are: Pluto Property and Investment Company Limited; Seagate Property Development and Investment Company Limited; Trans Ocean Property and Investment Company Limited.


An Arizona woman tried to smuggle three pounds of heroin in her pants, officials said. The 47-year-old Nogales, Arizona, resident tried to return to the U.S. from Mexico at a pedestrian border crossing Tuesday with the drugs, U.S. Customs and Border Protection said. She attempted to hide the heroin, worth more than $45,000, in the back of her pants, officials said.


On a typical day, Customs and Border Protection seize 7,910 pounds of drugs, according to the agency. According to the press release on the CBP website, during her attempt to enter the US, Nogales was referred for further inspection where she was found to be carrying three pounds of heroin, all strapped to her behind.


The Spokesman of the NationalCaretaker Committee of the Peoples Democratic Party (PDP) has denied being part of the yet-to-be registered Advanced Peoples Democratic Alliance (APDA). Prince Dayo Adeyeye, has dismissed a report that the caretaker committee was floating the party as “option B,” with regards to the leadership crisis in the opposition party.
 

“Those parading themselves as PDP stalwarts or stakeholders itching to form new political associations are, in fact, military apologists and nomadic political activists with no genuine political credentials, looking for a political window to position themselves for economic settlement or advantage. An inquiry into the background of these people will show they are the same people that superintended over the affairs of the PDP with impunity for over a decade and are responsible for the problems which they now claim to have a cure,” he said.

Members of the Imo State Security Council with all the heads of the Security Agencies in the State in attendance, met on Monday, May 8, 2017 at the Government House Owerri and at the end of the meeting, raised alarm over the Congestion and location of Owerri Prison.

Governor Rochas Okorocha who briefed Government House Correspondents at the end of the Security Council meeting said “the State is worried about the Owerri Prison Congestion, and the site of the Prison. The site is bad, just opposite the Government House. We are concerned with the number of inmates in the prison without adequate facilities”.

According to him, “the Council is therefore calling on the Federal Government to do something as quickly as possible to relocate the Owerri Prison from where it is now to a suitable place for the purpose of ensuring that we don’t have a jail break in the State. The Judiciary also requires a lot of renovations and personnel to dispense justice speedily. This will equally help in decongesting the prisons. The government has therefore declared a State of emergency on Judicial infrastructure”.

He also said that the Commissioner of Police in the State has officially declared that whistle blowing on criminals is allowed to help fish out criminals in the land, adding too that the traditional rulers of the communities hosting the airport should ensure adequate security around the airport especially now that the Cargo airport is about to take off”.

He continued “we have also noticed with dismay the rising spate of cultism which is among University students and secondary Schools. We have taken decision to review the laws in this regard and make it more punitive for offenders. The House of Assembly will take this up to make the appropriate laws to check the menace of cultism in our State”.

He Stated “we have noticed few cases of kidnapping suspects coming from Ngor-Okpala area. The security agencies are carefully watching the development in those places with a view to making sure that it does not rear its ugly head again”.

He further informed “We have also noticed that some Chinese individuals and companies are in the state engaging in illegal timber business, cutting trees in the state. This is not with the consent of the Imo State government. That act is hereby condemned. We have advised traditional rulers and State Development Council (SDC) members to be on guard and report anybody cutting timbers and trees in the state without approval by relevant government authorities”.

“We have also realized that there are a lot of people collecting illegal taxes in Imo State who produce fake receipts and uniforms and act as agencies of the state, extorting money from innocent citizens. We have frowned at this and has directed the Civil Defence to work with the relevant government agencies to bring this to a stop. Anybody arrested in this regard will be dealt with according to the law”, he stated.

The governor also said that “the Imo State government has approved the establishment of security trust fund and security public relations department. This will enable us ensure proper funding of the security sector because government alone can no longer handle the burden of funding the security agencies. With this, we are calling on all stakeholders and all good spirited individuals to key into this laudable programme of the government, the deputy governor will chair the program”.

He continued “We have embarked on review and completion of lists of suspected criminals in all our communities. The affected individuals will be invited to a meeting with the security agencies. This is in our bid to put up a prevention of crime rather than fighting crime”.

He also informed that “the council has approved the establishment of expanded security council which will involve all heads of tertiary institutions in the State, all heads of federal parastatals, security agencies, local government chairmen, head of Keke operators, clergy, market union, labour union and other unions as parts of this expanded Security Council. This meeting is scheduled to take place sometime this month to beef up the security challenges in the State”.

“Our attention has been brought to illegal mining in the State especially sand excavation. The men of civil defence has been mandated to bring to book all illegal miners in the State who doesn’t have government authorization to do so”, he stated.
